    Agreement to Terms

    By accessing the LabPups.com website or purchasing puppies or services from us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

    You must be at least 18 years old to purchase a puppy or services from LabPups.com or to enter into any agreement with us.

    No Veterinary or Legal Advice

    Information on this website, including any health, training, or nutrition recommendations, is for general informational purposes only and is not a substitute for professional veterinary advice, diagnosis, or treatment. Always consult your veterinarian regarding your dog's specific health needs. Nothing on this website constitutes legal advice.

    Puppy Purchase Terms

    Deposits and Payment

    • Deposit Amount: $1,200 non-refundable deposit required to reserve a puppy
    • Total Purchase Price: $2,549 (deposit applied toward total)
    • Payment Methods: Cash, check, credit card, and bank transfer accepted
    • Final Payment: Full payment is due before the puppy goes to their new home

    Why Deposits Are Non-Refundable

    When you place a deposit, we reserve your selection position and cannot sell that spot to another customer. We also base our breeding decisions and litter planning on deposits received. For these reasons, all deposits, partial payments, and full payments are non-refundable, except where we are unable to provide a puppy as described in these Terms.

    Deposit Flexibility and Buyer Cancellation

    While deposits are non-refundable, we provide flexibility when circumstances change:

    • If your requested color/gender combination is unavailable from a planned litter, you may transfer your deposit to a different color/gender or to a future litter
    • Transfers require advance notice and must be initiated by you

    Buyer cancellation:

    • If you decide not to proceed with the purchase for any reason after placing a deposit, all amounts paid are forfeited and will not be refunded
    • At our sole discretion, if we are able to resell your reserved spot or puppy, we may offer to apply part or all of your payments to a future litter. This is a courtesy and not a guaranteed right

    Chargebacks and Disputed Payments

    You agree not to initiate a chargeback or payment dispute with your bank or card issuer for any deposit or payment made under these Terms except in cases of fraud. If you initiate a chargeback that is not based on fraud, you agree to reimburse LabPups.com for any fees, costs, and reasonable attorney's fees incurred in responding to the chargeback, in addition to the original amount owed.

    Puppy Selection Process

    • Selection priority is based on the order deposits are received
    • Deposits reserve a color/gender combination, not a specific individual puppy
    • We work with you to match a puppy to your preferences and lifestyle based on the information you provide
    • Final puppy assignments are made at approximately 6-7 weeks of age
    • If we cannot reach you during the selection window, we will choose an appropriate puppy for you based on your preferences

    Pick-Up and Delivery

    • Puppies are typically ready to go home at around 7 weeks of age, subject to applicable law on minimum age for sale
    • Pick-Up: Available at our Charlotte, NC location at no additional charge
    • Nationwide Delivery: Available for an additional fee (buyer's responsibility)
    • Transportation costs and arrangements are the responsibility of the buyer

    Health Guarantee

    Our puppies are guaranteed to be free from major genetic defects for one year from the date of purchase.

    Genetic Health Guarantee (One Year)

    A "major genetic defect" means a genetic condition that negatively affects the dog's health. Examples include, but are not limited to:

    • Generalized demodex
    • Progressive Retinal Atrophy (PRA)
    • Exercise-Induced Collapse (EIC)

    Hip dysplasia is not covered under this guarantee. See "What Is NOT Covered" below.

    A defect that does not negatively affect the dog's health or quality of life is not covered, even where a technical genetic abnormality exists. In some cases medical treatment may not be necessary, even where a technical genetic abnormality is present.

    Puppy Condition at Go-Home

    • Puppies are current on age-appropriate vaccinations and deworming at the time of sale
    • Puppies are microchipped
    • You are responsible for your puppy's ongoing veterinary care. Please note the call-first requirement below and the guidance under the 10-Day Illness Guarantee before scheduling a non-emergency visit during your puppy's first days at home

    Guarantee Remedy Options

    If a covered genetic defect is diagnosed within one year of the purchase date and all conditions below are met, you may choose:

    • A replacement puppy, OR
    • A partial refund limited to the lesser of:
      • Half the original purchase price of the puppy, OR
      • The actual cost of repairing the defect (based on receipts)

    These remedies are your sole and exclusive remedies for covered genetic defects, as further described under "Exclusive Remedies and Warranty Disclaimer."

    Requirements to Qualify for Guarantee

    To qualify for genetic health guarantee coverage, all of the following conditions must be met:

    Notification Before Treatment:

    • You must contact us before receiving treatment for any suspected genetic condition
    • Written notice with details must be provided promptly upon diagnosis

    Veterinary Documentation:

    • Diagnosis must be made by a licensed veterinarian specializing in the field in question
    • Proof of the defect must be provided, along with complete veterinary records, diagnostic reports, surgical notes, and receipts for payment of procedures
    • We reserve the right to a second opinion
    • If a claim is approved, payment will be made after copies of all veterinary records, including surgical notes, and receipts for payment of the procedures have been provided

    Corrective Treatment:

    • Corrective surgical treatment must be completed to qualify for a refund
    • Dogs that do not undergo corrective surgical treatment are not eligible for a refund under the genetic health guarantee

    Proper Nutrition:

    • The dog must have been maintained on a good, highly digestible protein diet including vitamin C for the entire guarantee period
    • The only approved food is JaxMax. Improper nutrition or growth hormones can cause bones and joints to grow deformed and can lead to other serious health issues in a short period of time
    • Failure to follow the required nutritional guidelines disqualifies the claim

    How to Make a Claim

    To make a claim against the guarantee, you must provide us with all of the following:

    • The applicable information regarding the defect
    • Your veterinarian's name and phone number
    • A copy of your original sales receipt
    • The original health record
    • The veterinary documentation described above

    The Reality of Brindled Pups

    Brindled Labradors have unique colorations that may appear more exaggerated just after birth. This comes from the inclusion of a double recessive K gene, which allows the normally solid-colored Lab to display two or even all three Lab colors. They are rare and beautiful and also express the same recessive K gene if bred. Their temperament, intelligence, and health are the same as any normally colored Lab.

    As your dog ages, the brindled colors may shift in intensity, volume, and location. At times, your Lab may appear normally colored with slight undertones of grey or yellow, and months later, they may express their brindled pattern more strongly again. This is common and normal for brindled Labs. There will be no refunds given for loss of coloration, change in appearance, or dissatisfaction with aesthetic characteristics.

    10-Day Illness Guarantee

    Viruses and bacterial infections are not covered under the genetic health guarantee, as these are not genetic in nature. However, if your puppy develops symptoms of a virus, bacteria, or any other problem within ten days of purchase, call us immediately. If the sickness was contracted before the purchase date and symptoms developed later, we will gladly trade out your puppy for a healthy one.

    Important notes:

    • Please call us before seeking veterinary treatment so we can help determine whether a vet visit is necessary
    • If you take your puppy to the vet for treatment within this ten-day period, we are not responsible for the bill. This also applies to illnesses or defects other than viral or bacterial
    • Puppies have very delicate digestive systems. Changing dog foods, the stress of a new environment, or chewing on the wrong items can cause a temporary case of vomiting or diarrhea
    • Going to the vet unnecessarily at a young age may expose your puppy to a virus lingering in the clinic
    • Parvo Test Warning: If your vet performs a Parvo test within thirty days after a vaccine was administered, your puppy will test positive. This is a normal reaction to the vaccine and does not mean your puppy has Parvo

    For qualifying illnesses under this 10-Day Illness Guarantee, your sole remedy is a replacement puppy of comparable value when available. No refunds of the purchase price or veterinary expenses will be provided under this specific guarantee.

    What Is NOT Covered

    The health guarantee does not cover:

    • Hip dysplasia. Hip dysplasia means abnormal hip formation, which can arise from nutrition, growth rate, environment, parasite load, or injury. It is not covered under this guarantee
    • Injuries not caused by a genetic defect
    • Conditions resulting from accidents, improper care, improper nutrition, rapid growth, or environmental factors after purchase
    • Viruses and bacterial infections, which are not genetic in nature (subject to the 10-Day Illness Guarantee above)
    • Allergies, small skin irritations, localized demodex, ectropion, and entropion
    • Defects that simply cause your dog to be considered poor for breeding but are not necessarily harmful (example: cryptorchidism)
    • Any defect that does not negatively affect the dog's health or quality of life
    • Discounted or "as-is" puppies and dogs, which are sold with no guarantee whatsoever, including as to genetic defects, viruses, and bacterial infections. You accept the dog in its current condition

    Our primary intention is to sell puppies suitable for family pets. We make no guarantee as to their breedability. All puppies are sold with AKC limited registration unless otherwise indicated.

    AKC Registration

    All puppies are sold with AKC Limited Registration unless otherwise specified in writing.

    What this means:

    • Your dog will be AKC registered
    • Any puppies your dog produces will not be eligible for AKC registration
    • This reflects our primary intention to sell family companion dogs

    Full Registration Option:

    In select cases, we may upgrade limited registration to full registration status through our lease-back breeding program, at our discretion. This is done on a case-by-case basis and must be agreed upon in writing.

    Registration papers will be provided at the time of pick-up or delivery, or as soon as available. It is your responsibility to complete and submit the AKC registration application and pay any applicable fees.

    Adult Dog Sales

    Deposit and Payment Terms

    All deposits and payments toward adult dogs are non-refundable, even if you return the dog to us.

    Why Adult Dog Sales Are Final

    Placing an adult Labrador requires significant effort to ensure proper matching. Taking back an adult and rehoming them involves substantial costs for training, boarding, and health care. Due to these costs, it is rare that we profit from adult dog sales, and therefore all adult dog sales are final.

    Commitment Required

    Successfully integrating an adult Labrador into your home requires:

    • Commitment to following our guidance and training advice
    • Understanding of Labrador behavior and proper handling techniques
    • Patience during the adjustment period
    • Willingness to put in the necessary work

    Even fully trained Labradors need knowledgeable handlers to maintain their training. We will work with you to support a successful placement, but the responsibility for success ultimately rests with your family's commitment and follow-through.

    Training and Boarding Services

    Obedience Training Program

    • 21-Day Program: $1,500 (includes boarding and food)
    • Training Includes: Come, sit, stay, heel commands
    • Payment: Due in full at drop-off
    • Cancellation Policy: 7 days advance notice required for refund

    Training success depends heavily on the owner:

    • A trained Labrador requires a knowledgeable handler to maintain results
    • We can train your dog effectively, but we cannot control whether you follow our guidance or properly handle a trained dog
    • Therefore, all training payments are non-refundable once the program has begun

    For best results:

    • Follow our training methods exclusively and consistently
    • Avoid mixing techniques from other sources (books, TV shows, friends, etc.)
    • Understand that owners often need as much or more training than the dog
    • Commit to practicing and reinforcing what your dog has learned

    Boarding Services

    • Daily Rate: $42.50 per night
    • Reservations: Recommended, especially during holidays
    • Requirements: Dogs must be current on vaccinations (proof required)
    • Payment: Due at pick-up
    • Cancellation Policy: 48 hours advance notice required for refund of any prepayments

    Buyer Responsibilities

    By purchasing a puppy or adult dog from LabPups.com, you agree to:

    • Provide proper veterinary care, including regular check-ups and vaccinations
    • Provide a safe, loving home environment with proper nutrition, exercise, and training
    • Never abuse, neglect, or abandon the dog
    • Contact us immediately if you can no longer care for the dog (we have first right of refusal)
    • Not breed the dog without written authorization (per AKC limited registration terms and any separate breeding agreement)

    Return and Rehoming Policy

    Lifetime Commitment

    We have a lifetime commitment to every puppy we produce. If at any time you cannot keep your LabPups dog, you must contact us first.

    You may not:

    • Sell the dog without our knowledge and written consent
    • Give the dog away without our knowledge and written consent
    • Surrender the dog to a shelter or rescue organization without our knowledge and written consent

    We will:

    • Assist with rehoming if necessary
    • Exercise our first right of refusal if we choose
    • Work with you to find the best solution for the dog

    Violation of this policy may result in legal action and may be considered a breach of contract.

    Liability Limitations and Exclusive Remedies

    While we take every precaution to ensure the health and temperament of our puppies, we cannot guarantee:

    • Adult size, weight, or exact color shade
    • Show quality or performance in competitions
    • Breeding quality or conformation (all puppies sold with limited registration unless otherwise agreed)
    • Compatibility with all family members, children, or other pets
    • Specific personality traits or training outcomes

    Exclusive Remedies and Warranty Disclaimer

    The remedies described in the Health Guarantee section (replacement puppy or partial refund, as applicable) and the 10-Day Illness Guarantee (replacement puppy only) are your sole and exclusive remedies for any claims relating to your puppy's health, genetic conditions, or fitness for any particular purpose.

    To the fullest extent permitted by North Carolina law:

    • No other warranties, express or implied (including any implied warranties of merchantability or fitness for a particular purpose), are made, and any such warranties are expressly disclaimed
    • Our total liability is limited to the remedies specified in these Terms
    • We are not responsible for veterinary expenses beyond those covered in the guarantee terms, consequential or indirect damages, lost time, emotional distress, or other non-economic damages

    Website Use

    When using LabPups.com, you agree to:

    • Provide accurate and current contact information
    • Not use the website for any unlawful purpose
    • Not attempt to gain unauthorized access to any part of the website, server, or systems
    • Respect our intellectual property rights, including photos, text, logos, and branding
    • Not reproduce, distribute, or modify website content without our prior written permission

    User-Submitted Content

    If you submit reviews, photos, testimonials, or other content to us:

    • You represent that you own or have the right to share that content
    • You grant LabPups.com a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with our business, including on our website and social media, unless you revoke such permission in writing

    Communications Consent

    By providing your contact information, you consent to us contacting you by phone, email, or text message regarding your current or future purchases, subject to applicable law. You may opt out of marketing communications at any time, but we may still contact you about active or past transactions.

    Privacy

    Our collection and use of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using our website or services, you consent to our collection and use of your information as described in that policy.

    Dispute Resolution and Governing Law

    Informal Resolution

    Before filing any legal action against us, you agree to first provide written notice of your dispute and allow us 30 days to attempt to resolve the issue informally.

    Venue and Governing Law

    These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles. Any disputes arising from these Terms or your purchase shall be brought exclusively in the state courts located in Mecklenburg County, North Carolina. You agree to the personal jurisdiction of these courts.

    Attorney's Fees

    In any action arising out of or relating to these Terms or any puppy or service purchase, the prevailing party shall be entitled to recover its reasonable attorney's fees and costs, in addition to any other relief permitted by law.

    Modifications to Terms

    We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website with an updated "Last Updated" date. Your continued use of our website or services after modifications constitutes acceptance of the updated Terms.
